General Terms and Conditions (GTC)
1. Scope
The following terms and conditions apply to all orders placed through our online shop.
Our online shop is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
An entrepreneur is a natural or legal person or a legally capable partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
2. Contracting parties, conclusion of contract, correction options
The purchase agreement is concluded with:

By placing the products in the online shop, we are making a binding offer to conclude a contract for these products.
You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process.
The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button.
You will receive a confirmation email immediately after submitting your order.
3. Contract language, contract text storage
The language available for concluding the contract is German.
We save the contract text and send you the order details and these terms and conditions in text form.
You can view the contract text in our customer login area.
4. Delivery conditions
4.1 Shipping costs
Standard delivery costs €4.90 .
Free shipping to Germany, Austria and Switzerland applies to all orders with a merchandise value of €50 or more .
4.2 Delivery options
We ship the products to the delivery address specified during the ordering process.
Self-collection is not possible.
Changing the delivery address is generally possible. However, a change of address may cause delivery delays.
Please note that some products or materials are shipped from abroad. In these cases, the delivery time may be longer.
5. Payment
5.1 Prices
The prices valid at the time of ordering apply.
All prices are total prices and include statutory VAT.
5.2 Payment methods
In our online shop, the payment methods displayed during the ordering process are available to you.
6. Return and Cancellation Policy
6.1 Right of withdrawal
You have the right to cancel your order within 30 days of receiving the goods.
To exercise your right of withdrawal, you must send us a clear statement by email of your decision to withdraw.
6.2 Return policy

The goods must be returned unused, undamaged and in their original packaging.

The buyer bears the costs of the return shipment.
6.3 Refund
After receiving and inspecting the return, we will refund the purchase price within 14 days via the originally used payment method.
A refund will only be issued if the goods are in perfect condition.

7. Custom-made items (handcrafted & personalized)
Some of our jewelry pieces are individually made to order.
This includes, in particular, handcrafted jewelry from the Handcrafted collection, personalized engravings, and jewelry with individually specified dimensions.
These products are manufactured specifically according to the customer's specifications and are not pre-made stock items.
Exclusion of the right of withdrawal
According to § 312g para. 2 no. 1 of the German Civil Code (BGB), there is no right of withdrawal for custom-made products if the production is clearly tailored to the customer's personal needs. This applies in particular to:

Jewelry with customer-specific dimensions (e.g., ring inner diameter)

Custom-made items within the Handcrafted Collection
Responsibility for customer information
The customer is responsible for ensuring that all data provided during the customization process (e.g., engraving texts, spellings, or dimensions) is correct and complete.
Gipfelschimmer accepts no liability for errors resulting from inaccurate or unclear customer information.
Craftsmanship features
Slight variations in structure, surface or shape may occur in handmade products.
These do not represent a defect, but are characteristic features of handcrafted production.
Statutory warranty rights remain unaffected.
8. Warranty and Guarantees
8.2 Warranty Law
The statutory warranty rights apply.
8.3 Guarantees and Customer Service
Information on any additional warranties that may exist, as well as their terms and conditions, can be found with the respective product and on the corresponding information pages in the online shop.

8.4 Optional extended warranty “Lifetime Warranty”

For selected products, we offer an optional, paid extended warranty ("Lifetime Warranty") at a price of €9.90 per product .
The additional warranty is voluntary and only becomes effective if it is actively selected during the ordering process. -

Content and scope:
The additional warranty covers material and manufacturing defects in the event of intended use, in addition to the statutory rights.

Duration / Target group / Area:
The guarantee applies for the duration of use of the piece of jewelry by the original purchaser, is non-transferable and is valid within the EU and Switzerland. -
Services provided under warranty:
At our discretion, we will repair, replace, or refund the purchase price.
Exclusions (e.g. normal wear and tear, loss, improper use, chemical influences, external interference) are set out in the warranty conditions. -
Claim:
In case of a warranty claim, please send an email with your order number, a description of the defect, and clear photos or videos to support@gipfelschimmer.de . -
Your statutory warranty rights remain unaffected.

No retroactive application:
The lifetime guarantee is valid from November 1, 2025 , and only applies to orders where it was actively purchased.
Retroactive application is excluded.
9. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
10. Other information – AI technology
We use AI technology. Some of our models are AI-generated.
Our images are protected by copyright and may only be used with explicit permission.
We reserve the right to display our product images even when used by third parties.
